Surfing involves inherent risks. While we provide information to help you surf safely, you are ultimately responsible for assessing conditions and your own abilities. Always prioritize your safety and surf within your skill level.
Agreement to Terms
These Terms of Service ("Terms") govern your access to and use of the Surf & Watersports Madeira website at madeirasurf.org (the "Service"), operated by Surf & Watersports Madeira ("we," "us," or "our").
By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.
Description of Service
Surf & Watersports Madeira provides:
- Information about surf spots in Madeira, Portugal
- Recommendations for surf schools and operators
- Safety information and guidelines for surfing in Madeira
- Tools to help match surfers with appropriate spots based on skill level
- General information about surf conditions and seasons
Our Service is informational in nature. We do not directly provide surfing lessons, equipment rental, or guided surf experiences.
User Responsibilities
By using our Service, you agree to:
- Provide accurate information about your surfing experience and skill level
- Honestly assess your own abilities when choosing where to surf
- Check current conditions before entering the water
- Follow all safety guidelines and local regulations
- Respect local surf communities and lineup etiquette
- Use the Service only for lawful purposes

Assumption of Risk

- You are solely responsible for your decisions about where and when to surf
Third-Party Services
Our Service may recommend or link to third-party surf schools, operators, and other businesses. You acknowledge and agree that:
- We are not responsible for the services, quality, safety, or practices of any third-party operators
- Any bookings or arrangements you make with third-party operators are between you and that operator
- While we verify operators before listing them, we cannot guarantee their ongoing compliance with our standards
- Third-party websites have their own terms and privacy policies that govern your use
- We may receive referral fees from operators when you book through our recommendations
Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Accuracy or completeness of surf spot information
- Reliability of condition reports or forecasts
- Suitability of recommendations for any particular user
- Availability or uptime of the Service
- Safety of any surf spots or operators mentioned
We make reasonable efforts to provide accurate information, but conditions change constantly and errors may occur. Always verify conditions independently before surfing.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- We shall not be liable for any personal injury, death, property damage, or other damages arising from your use of information provided on our Service

These Terms shall be governed by and construed in accordance with the laws of Portugal, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Funchal, Madeira, Portugal.
Changes to Terms
We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. Your continued use of the Service after any changes constitutes acceptance of the new Terms.
Severability
